1. Acceptance of Terms

By downloading, installing, accessing, or using the Fliq mobile application ("App") or any related services at fliqapp.co, you agree to be legally bound by these Terms & Conditions ("Terms"). These Terms form a binding agreement between you ("User" or "you") and Fliq ("we," "us," or "our").

If you do not agree to these Terms in their entirety, you must immediately stop using the App and uninstall it from your device.

These Terms apply alongside our Privacy Policy, which is incorporated by reference. In the event of any conflict, these Terms take precedence unless stated otherwise.

2. Description of Service

Fliq is an AI-powered dating assistant designed to help users craft better messages, analyze conversation dynamics, and improve their dating communication through psychology-backed insights. The App provides:

• AI Reply Generation: Upload a conversation screenshot to receive multiple suggested reply options in various tones (warm, confident, playful, authentic, etc.)
• Conversation Analysis: Text-based practice mode to analyze your existing messages and identify areas for improvement
• Psychology Education: Challenges and lessons on attachment styles, love languages, and communication patterns
• Conversation Memory: (Pro) Save and reference past conversation sessions for context-aware follow-up suggestions
• Personalized Coaching: Suggestions tailored to your psychological profile established during onboarding

The App uses Google Gemini AI for generating suggestions, Supabase for secure data storage, and Cloudflare Workers for secure API routing. Features and availability may change over time with or without prior notice.

3. Eligibility

Additionally, you represent that:

• You have the legal capacity to enter into a binding agreement in your jurisdiction
• You are not prohibited from using the App under any applicable law
• You are not a resident of a country subject to a U.S. government embargo or designated as a terrorist-supporting country
• You will use the App only for personal, non-commercial purposes

4. Account Registration

Certain features of Fliq require you to create an account. You may register using an email address and password, or through a supported third-party provider (Google Sign-In, Apple Sign-In). By creating an account, you agree to:

• Provide accurate, complete, and current information during registration
• Maintain and promptly update your account information to keep it accurate
• Maintain the confidentiality of your login credentials and not share them with any third party
• Accept full responsibility for all activity that occurs under your account
• Notify us immediately at hello@fliqapp.co if you suspect unauthorized access to your account

We reserve the right to refuse account registration, or to suspend or terminate an existing account, at our sole discretion. You may not create an account on behalf of another person without their express authorization.

5. Acceptable Use

Fliq is built to help people connect more authentically. You agree to use the App only for lawful, ethical purposes consistent with that spirit. The following are expressly prohibited:

We reserve the right to investigate suspected violations and to suspend or permanently terminate your account, with or without prior notice, if we determine — in our sole reasonable discretion — that you have violated these Terms or acted in a manner harmful to other users, to us, or to third parties.

Fliq offers a free tier and a premium subscription ("Fliq Pro"). Here is everything you need to know:

Fliq is available for free with the following limitations:

• A limited number of AI reply suggestions per day (the exact limit is displayed in the app and may change)
• Access to a subset of educational challenges and lessons
• No conversation memory (session history not saved between uses)

We reserve the right to adjust free-tier limits at any time. Fliq Pro removes daily limits and unlocks all features. Free-tier limits are enforced per account — creating multiple accounts to circumvent limits is a violation of Section 5 (Acceptable Use) and may result in account termination.

9. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, design, user interface, software, source code, prompts, and underlying technology — are owned by Fliq or its licensors and are protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable, personal license to access and use the App solely for your personal, non-commercial purposes.

This license does not include any right to: sublicense, sell, or transfer the App or your access to it; copy, modify, or distribute any part of the App; use any data mining, robots, or similar data gathering methods; or frame or mirror any portion of the App without our prior written consent.

10. Your Content

You retain full ownership of any content you upload to Fliq, including conversation screenshots and text you enter ("Your Content").

By uploading Your Content, you grant Fliq a limited, non-exclusive, worldwide, royalty-free license to process Your Content solely for the purpose of providing the service to you — specifically, to transmit screenshots to our AI processing pipeline and return suggestions to your device. This license is temporary and does not extend beyond what is necessary to operate the App for you.

We do not use Your Content to train AI models, build advertising profiles, or share with other users. Screenshots are not retained after processing. See our Privacy Policy for full details.

11. Privacy

Your use of Fliq is governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains in detail what data we collect, how we use it, what third-party services receive it, and your rights regarding your personal information. By using the App, you acknowledge that you have read and understood our Privacy Policy.

12. Disclaimer of Warranties

13. Limitation of Liability

To the maximum extent permitted by applicable law, Fliq, its affiliates, officers, directors, employees, agents, suppliers, and licensors shall not be liable for:

• Any indirect, incidental, special, consequential, exemplary, or punitive damages
• Loss of profits, revenues, data, goodwill, or other intangible losses
• Damages resulting from your use of or inability to use the App
• Damages resulting from any AI-generated content or suggestions you act upon
• Damages resulting from unauthorized access to your account or data
• Damages resulting from the conduct or content of any third party
• Damages resulting from errors, bugs, or interruptions in the service

In no event shall our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the App exceed the greater of: (a) the total amount you paid to us (via App Store / Google Play) in the twelve (12) months immediately preceding the claim, or (b) €50 EUR. Some jurisdictions do not allow these limitations, in which case they apply to the fullest extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Fliq and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of or access to the App; (b) your violation of these Terms; (c) your violation of any rights of any third party; (d) any content you upload to the App; or (e) any messages you send or actions you take based on AI-generated suggestions. We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense.

15. Termination

By you: You may stop using Fliq and delete your account at any time through App Settings → Account → Delete Account. Deletion permanently removes your account and associated data, subject to the retention periods in our Privacy Policy. If you have an active subscription, cancelling your account does not automatically cancel the subscription — you must cancel it separately through your App Store or Google Play settings.

By us: We may suspend or terminate your access to the App at any time, with or without cause and with or without notice, including for: violation of these Terms, suspected fraudulent or abusive activity, extended account inactivity, or as required by law. Upon termination, your right to use the App ceases immediately.

The following sections survive termination of these Terms: Section 9 (Intellectual Property), Section 12 (Disclaimer of Warranties), Section 13 (Limitation of Liability), Section 14 (Indemnification), Section 16 (Dispute Resolution), and Section 17 (Governing Law).

16. Dispute Resolution

We want to resolve any issues quickly and fairly. If you have a concern or dispute, please contact us first at hello@fliqapp.co. We will make every effort to resolve the issue informally within 30 days.

If a dispute cannot be resolved informally, you and Fliq agree to submit to the jurisdiction of the courts specified in Section 17. Nothing in these Terms prevents either party from seeking urgent injunctive or interim relief in any competent court where necessary to prevent irreparable harm.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or your use of the App that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts located in Germany.

Notwithstanding the foregoing, if you are a consumer residing in the European Union, you retain the benefit of any mandatory consumer protection provisions of your country of residence. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

18. Changes to These Terms

We reserve the right to modify these Terms at any time to reflect changes in our service, applicable law, or business practices. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Post a notice in the App for significant changes
• Where required by law, obtain fresh consent before changes take effect

Your continued use of Fliq after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the App. We encourage you to review these Terms periodically.
